Terms of Service for Kazzylen Hosting and Domain (KAZZYLEN HD)

Welcome to Kazzylen Hosting and Domain (KAZZYLEN HD), a subsidiary of KAZZYLEN LTD (RC 2015785), based in Lagos and Abuja, Nigeria as Africa coverage head offices. These Terms of Service (“Terms”) govern your access to and use of the hosting and domain services provided by KAZZYLEN HD in partnership with EXCEL TOTAL SOLUTION ENTERPRISE, Malaysia. By using our services, you agree to be bound by these Terms.

1. Definitions

1.1 “KAZZYLEN HD” refers to Kazzylen Hosting and Domain, a subsidiary of KAZZYLEN LTD. 1.2 “Services” refers to hosting and domain registration, and any related services provided by KAZZYLEN HD. 1.3 “User” refers to any individual or entity using KAZZYLEN HD services.

2. Account Registration

2.1 Eligibility: Users must be at least 18 years old or have parental/guardian consent to use our services. 2.2 Account Creation: Users must provide accurate and complete information during registration. Failure to do so may result in account suspension or termination. 2.3 Account Security: Users are responsible for safeguarding their account credentials and promptly reporting any unauthorized access.

3. Services Provided

3.1 Hosting Services: KAZZYLEN HD offers shared, VPS, Cloud hosting, WP hosting, and dedicated hosting plans. Service specifications are detailed on our website. 3.2 Domain Registration: Users can register and manage domain names through our platform, subject to availability and regulatory compliance. 3.3 Third-Party Services: Some services may involve third-party providers, including EXCEL TOTAL SOLUTION ENTERPRISE. By using such services, you agree to their respective terms.

4. Payment Terms

4.1 Payment Methods: Payments can be made via authorized gateways, including Stripe.

4.2 Billing Cycle: Services are billed on a recurring basis unless canceled by the user. 4.3 Refunds: Refunds are subject to our Refund Policy. For disputes involving unauthorized payments, see Section 5. 4.4 Late Payments: Accounts with overdue invoices may be suspended until full payment is received.

5. Unauthorized Transactions and Disputes

5.1 If an unauthorized payment is identified, KAZZYLEN HD will:

  • Refund the amount to the cardholder.
  • Report the transaction to the authorities.
  • Terminate the associated account. 5.2 Dispute Resolution: In payment disputes, evidence of authorization must be provided. If the dispute is resolved in favor of the cardholder, the user’s account will be terminated.

6. Acceptable Use Policy

6.1 Users agree to use services only for lawful purposes. Prohibited activities include:

  • Hosting or distributing illegal content.
  • Spamming or phishing activities.
  • Engaging in activities that compromise service integrity. 6.2 Violations of this policy may result in immediate account suspension or termination.

7. Data Privacy

7.1 User Data: KAZZYLEN HD collects and processes user data in accordance with our Privacy Policy. 7.2 Data Security: We employ industry-standard measures to secure user data but cannot guarantee absolute security.

8. Service Uptime and Maintenance

8.1 Uptime Guarantee: KAZZYLEN HD aims to provide 99.9% service uptime. Scheduled maintenance and unforeseen technical issues may cause temporary disruptions. 8.2 Maintenance Notifications: Users will be notified in advance of any planned maintenance that may impact service availability.

9. Termination of Services

9.1 By User: Users may terminate services at any time through their account dashboard. 9.2 By KAZZYLEN HD: We reserve the right to terminate services for:

  • Non-payment of dues.
  • Violation of these Terms or applicable laws.
  • Unauthorized use of payment methods.

10. Limitation of Liability

10.1 KAZZYLEN HD is not liable for indirect, incidental, or consequential damages resulting from the use of our services. 10.2 Our total liability is limited to the fees paid for the affected service during the prior billing cycle.

11. Intellectual Property

11.1 All content, trademarks, and materials on our platform are the property of KAZZYLEN HD or its partners and are protected by intellectual property laws. 11.2 Users are granted a limited license to use the services for personal or business purposes but may not redistribute or modify the content without permission.

12. Amendments

12.1 KAZZYLEN HD reserves the right to amend these Terms at any time. Users will be notified of significant changes, and continued use of our services constitutes acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

13.1 These Terms are governed by the laws of Nigeria. 13.2 Disputes arising from these Terms will be resolved in Nigerian courts.
